These general terms and conditions of sale, detailed below, govern the contractual relationship between any user of the website www.meubles-en-merrain.fr wishing to make a purchase from ROLAND PONS via the website www.meubles-en-merrain.fr (hereinafter referred to as “the customer” or “you”), belonging to the sole proprietorship ROLAND PONS.
These general terms and conditions of sale, as well as all information presented on this website, are written in French. They apply to all orders placed on the website www.meubles-en-merrain.fr and are valid only for deliveries within mainland France (excluding Corsica and overseas departments and territories). These general terms and conditions of sale are the only applicable terms and supersede all other conditions, unless otherwise agreed in advance, expressly and in writing, or unless specific conditions are agreed upon between the parties. ROLAND PONS may modify certain provisions of these general terms and conditions at any time. Consequently, it is necessary to consult these terms and conditions each time you visit the website www.meubles-en-merrain.fr (hereinafter referred to as the “Site”).
These modifications are binding from the date they are published online and will apply to orders placed after that date. Each purchase on the Site is governed by the terms and conditions applicable on the date of the order. The customer may only validate their order after having read and accepted these terms and conditions by checking the designated box. ROLAND PONS considers that by validating their order on the website www.meubles-en-merrain.fr, the customer accepts the terms and conditions of sale without reservation, having duly read them, regardless of the payment method chosen. By accepting these terms and conditions of sale when placing an order, the customer declares that they have the legal capacity to enter into a contract within the meaning of Articles 1123 et seq. of the French Civil Code.
Article 1: ORDERING AND ORDER CANCELLATION
After selecting the items they wish to order and reviewing their product descriptions, the customer must log in. They will then see the details of their order and the total price in euros, including VAT. They can then choose their payment method and confirm their order by double-clicking. The delivery deadline is clearly specified before order confirmation. Before confirming their order, the buyer should carefully review the order details (items ordered, payment method, delivery time) and the total price including VAT. They can modify their order and make corrections at any time before confirming it. Order confirmation implies acceptance of the prices and descriptions of the goods.
ROLAND PONS will send an email to the buyer to confirm that their order has been received. The customer can view their order details at any time in their “My Account” section, which will be activated upon entry of their contact information on the ROLAND PONS website.
The company ROLAND PONS reserves the right to refuse to execute a delivery or to honor an order in cases where the customer has not fully or partially paid for a previous order, if this failure does not result from a fault of the company ROLAND PONS, or in the event that a payment dispute remains.
All orders placed on the Site must be accompanied by full payment of the order price. All correspondence should be addressed to the company ROLAND PONS, whose contact details are provided on the order confirmation sent by email after any order placed on the website www.meubles-en-merrain.fr.
The customer has 14 days from receipt of their order to exercise their right of withdrawal with the seller.
ROLAND PONS reserves the right to refuse returns of damaged goods. Requests for exchange or refund must be made by registered letter with acknowledgment of receipt sent to the ROLAND PONS address indicated on the order form; the postmark will serve as proof of mailing.
The sale will therefore be firm and final from this final date (delivery date + 14 days) if the customer has not exercised their right of withdrawal within the allotted time. If ROLAND PONS or the carrier cannot contact the customer or agree on a delivery date within 15 days of the goods being made available, ROLAND PONS will send the customer a registered letter with acknowledgment of receipt. This letter will request the customer to contact the Delivery Department within 15 days to arrange a delivery date. Except in cases of force majeure, which must be justified, ROLAND PONS will charge storage fees of a minimum of €10 per additional day from the end of the aforementioned period. Customers wishing to postpone delivery of their order may request this from ROLAND PONS, whose contact details are provided on the order confirmation sent by email after any order placed on the website www.meubles-en-merrain.fr.
Article 2: PAYMENT
The customer chooses their payment method.
1. By bank card
Payment by credit card is not yet available on the site.
2. By check
payment of the entire order
The customer must send their payment along with a copy of their identity document to the company ROLAND PONS, whose contact details are indicated on the order form sent by email after any order placed on the website www.meubles-en-merrain.fr.
The order is then reserved for 5 business days. After this period, if the check has not been received, the order will be canceled. The order will be confirmed upon receipt of the check. The customer will then be notified by email from ROLAND PONS.

Article 3: PRICES AND PRODUCTS
The prices shown on the website www.meubles-en-merrain.fr are in Euros, inclusive of VAT, and do not include delivery. Delivery charges, which are the responsibility of the customer, are specified in the shopping cart and confirmed during order validation. ROLAND PONS reserves the right to modify its prices at any time. Items will be invoiced based on the price displayed on the website at the time the order is placed.
Delivery charges are free until December 31, 2014.
Article 4: Retention of Title Clause
The company ROLAND PONS may retain ownership of the delivered goods until full payment of all sums due under this contract. The buyer is prohibited from transferring ownership of the goods, whether free of charge or for consideration, or from moving them from the delivery address indicated, and is obligated to notify all third parties of this retention of title, particularly in the event of any enforcement proceedings (precautionary attachment, etc.). Failure to pay may result in the repossession of the goods.
Article 5: AVAILABILITY AND DELIVERY TIMES
Delivery times and the delivery deadline are clearly specified on the order summary before validation.
If the initially scheduled delivery date is not met, the buyer would have the option to cancel their order and request a refund of the sums paid, by registered letter with acknowledgment of receipt sent to the company ROLAND PONS whose contact details are indicated on the order form sent by email after any order placed on the website www.meubles-en-merrain.fr.
It is reminded that the customer may then invoke the provisions of Article L.114-1 of the Consumer Code. However, compliance with the aforementioned delivery deadlines is subject to:
a) in the absence of any case of force majeure or fortuitous event or strike.
b) in the absence of any fault on the part of the buyer in particular the non-compliance of the payment conditions stipulated in the order or the non-communication of the information necessary for the normal execution thereof or for the modification of his order, or finally in the event of an impossibility of delivering the furniture to his home due to major unreported passage difficulties.
Your products are manufactured from the moment your order is registered by the company ROLAND PONS.
Orders are not processed administratively on weekends and public holidays.
Upon receiving your order, we check the availability of the product(s) ordered if it is in stock. In this case, the stock consists of individual parts, and the furniture assembly and finishing work still needs to be completed.
In the event that a product is unavailable after order confirmation, the company ROLAND PONS will inform the customer by email of the cancellation of the order and will offer a refund of the amounts actually debited, by check within 30 days.
For any order containing one item that is in stock and one item that is not, which must be manufactured, the latest delivery date—clearly indicated in the order summary before the customer confirms the order—is based on the longer lead time. The ordered items will be delivered when all items are available.
However, the customer has the option to order the items separately.
Article 6: DELIVERY TERMS AND CONDITIONS
6.1 Delivery of goods
Deliveries cannot be made outside mainland France (i.e., excluding Corsica and overseas territories).
The customer will be contacted by the company ROLAND PONS or the carrier upon receipt of their goods to arrange an appointment.
In the event that the company ROLAND PONS subcontracts its deliveries to partners, it has ensured the competence and reliability of the latter.
The buyer (or a third party duly authorized in writing) agrees to be present on the agreed delivery date and to inspect the goods upon receipt. It is the customer’s responsibility to verify, prior to ordering, particularly with regard to product specifications in terms of size and volume, that the goods can be transported via standard access routes to the delivery location. Standard delivery is carried out by two people.
If access conditions are difficult due to access routes (spiral staircases, narrow elevators, narrow doorways, etc.) and require delivery by four people, with or without the use of a lift, the customer will be asked by ROLAND PONS to contact them. The order cannot be validated on the website. ROLAND PONS cannot be held responsible for the inability to deliver the goods to the customer’s address. If the customer is not present at the time of delivery or has failed to mention any access difficulties, the goods will be made available to the customer at ROLAND PONS’ headquarters and will be considered delivered.
6.2 Removal of goods
If the goods are collected from the company or the carrier, the customer must provide a copy of their order, proof of identity, and possibly pay the remaining balance of their order.
Article 7: WARRANTY
The guarantee of ROLAND PONS is that provided for by the consumer code mentioned in articles L211-4 to L211-13 of this code and that relating to defects in the thing sold under the conditions provided for in articles 1641 to 1648 and 2232 of the civil code.
– Article L. 211-4 of the Consumer Code:
“The seller is obligated to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller’s responsibility under the contract or was carried out under the seller’s supervision.”
– Article L. 211-5 of the Consumer Code:
“To be compliant with the contract, the goods must:”
1/ be fit for the purpose for which goods of the same type are normally used and, where applicable:
– correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model
– to possess the qualities that a buyer can legitimately expect, given the public statements made by the seller, particularly in advertising or labelling
2/ Or possess the characteristics defined by mutual agreement between the parties or be suitable for any special purpose sought by the buyer, brought to the seller’s attention and accepted by the latter.
– Article L.211-12 of the Consumer Code:
“The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.”
– 1641 of the Civil Code:
“The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for its intended use, or which diminish that use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.”
– Article 1648, paragraph 1 of the Civil Code:
“The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect.”
Article 8: Information Technology and Freedom
The user freely consents to the use of the personal information they provide when placing their order by ROLAND PONS for order management purposes, as well as for direct marketing of similar or complementary products or services. In accordance with French Law No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, any person has the right to access, rectify, and object to the processing of their personal data, free of charge except for any costs associated with transmitting the objection, and in a simple manner.

This company is registered in the national register of furniture manufacturers under number FR026019. This number guarantees that the company Roland PONS, by joining eco-mobilier, complies with the regulatory obligations incumbent upon it pursuant to article L541-10-1 10° of the environmental code.
